Because we practice before both the appellate and trial courts, we understand the differences and similarities involved in successfully advocating for our clients throughout all stages of the legal process. Our consulting practice is designed to share our expertise with colleagues and their clients.
For example, we assist trial counsel in drafting a wide variety of motions and briefs before the trial court. These typically include responding to complex summary judgment/adjudication motions, anti-SLAPP motions, motions in limine, and countless other pre-trial and post-trial motions. Besides drafting opposition briefs, we are also able to provide another “set of eyes” to review briefs and provide a fresh perspective to enhance the likelihood of success.
In addition to preparing written briefs and motions, we are available to work collaboratively with trial counsel to ensure that the record is properly preserved for appeal. Because trial attorneys are often unfamiliar with the sometimes subtle and highly technical rules governing appeals, our consulting services allow trial attorneys to do what they do best - try cases - while leaving us to worry about potential appellate issues.
Underlying our consulting practice is the practical knowledge Mr. Liberson obtained during his appellate clerkship regarding the judicial decision making process. We understand that judges and their clerks are extremely busy. Consequently, our advocacy at all stages of the legal process is predicated upon the reality that courts appreciate attorneys who are able to effectively advocate for their clients while getting “straight to the point.” Therefore, we devote substantial resources to the preparation of well-written briefs that succinctly analyze complex legal issues in a manner that captures the attention of the court, research attorney, or law clerk.
